Final Guidelines and Step-by-Step Guide for Filing a Trademark Application in Pakistan

To assist applicants in successfully filing a trademark application in Pakistan, follow these guidelines based on the Trademark Ordinance, 2001 and Trademark Rules, 2004.

Step 1: Request for Trademark Search (Optional)

Before applying, it’s recommended to check if similar trademarks already exist. You can request a search by submitting Form TM-55 with a fee of PKR 1,000.

  1. Fill out Form TM-55 for one class per search.
  2. Attach two representations of the mark on durable paper.
  3. Submit the form along with a pay order or bank draft.

Alternatively, visit IPO offices for a Personal Search by paying PKR 300 for 15 minutes.

Step 2: Filing the Trademark Application (Form TM-1)

Once the search is complete, proceed with the trademark application using Form TM-1.

  1. Fill TM-1 in duplicate and attach six representations of the mark on durable paper.
  2. Specify the goods or services class (use separate applications for different classes).
  3. Complete the applicant’s details, including name, nationality, address, and any applicable color claims.
  4. Sign the form. If filing on behalf of a firm, a power of attorney (Form TM-48) may be required.

Step 3: Pay Filing Fee

Submit a PKR 3,000 filing fee through a pay order or bank draft payable to Director General, IPO-Pakistan.

Step 4: Registration Process and Examination

  1. Upon receiving your application, you will be given a trademark number and acknowledgment.
  2. Within three months, an examination report will be issued. Any objections are notified via a Show Cause Notice, requiring a response within two months.
  3. If the application passes, it is published in the Trademark Journal. After two months without opposition, you will receive a Demand Notice to submit Form TM-11 and pay the PKR 9,000 registration fee.

Step 5: Registration Certificate Issuance

Once the registration fee is received, the Registrar issues a Registration Certificate valid for 10 years.

Key Sections and Support
